Many construction accident victims are required to go through the worker’s compensation system. There are cases, however, in which the injury is the fault of someone other than the victim’s employer. Say, for example, that the worker was using a piece of defective equipment and an accident occurred due to the defect. In such a situation the worker would deal with his or her employer through worker’s comp but would also be able to sue the equipment manufacturer directly. In such a situation it is necessary to prove the extent to which the harm was caused by the defective equipment and not some form of negligence on the part of the employer.

Third-party liability in such cases are another situation which may involve the use of expert witnesses. The manufacturer of any defective equipment will likely attempt to pass blame to the construction company itself. They may claim that the company failed to adequately maintain the equipment or that the victim was not properly trained in its use. An expert witness will offer reports and testimony stating whether or not they believe the accident occurred due to the equipment being defective. They will also state whether they believe the accident could have been prevented by better training, etc. When handling such a matter it is important that you retain a lawyer familiar with questioning such experts.
