Child Care Abuse & Negligence
Experienced & Dedicated Personal Injury Lawyers
According to the most recent data provided by Child Trends, nearly one third of children between the age of one and four regularly receive child care from a non-relative. Many parents in Texas rely on professional caregivers to keep their children healthy and safe while they are at work or during other times of the day. Sadly, far too many child care professionals fail to live up to their most basic duties. Negligence — and worse, intentional abuse — remain serious problems at daycares.
Negligent/abusive child care providers must be held accountable for their misconduct. At DC Law, our Austin child care abuse/negligence attorneys are strong, aggressive advocates for Texas parents. If your kid was injured as a result of abuse or negligence in an Austin, TX daycare or child care center, we can help. The Texas Department of Health and Human Services is responsible for licensing and regulating daycares and other professional child care providers. Under Texas state law, licensed child care centers owe certain duties to the kids they watch and to parents that they serve. The physical, psychological, and emotional well being of young children must always be protected. When daycares fail to live up to their duties, they can and should be held legally liable for any resulting injuries.
To hold a child care provider legally liable, Texas parents must be able to prove the daycare’s negligence played a role in contributing to their child’s injuries. In child care injury cases, negligence comes in a wide range of different forms. It could be something as simple as an injury that occurred because an inattentive day care professional failed to provide adequate supervision.
Serious injuries could also occur as a result dangerous conditions on the property, or because a child was allowed to play with defective toys or otherwise broken equipment. Daycares are also responsible for screening employees and properly training their staff. If a child is injured because of intentional abuse, immediate action must be taken.
If your child was injured at a Texas daycare center, there are many legal options available. In cases involving possible abuse, the police may need to be involved. Abusing a child is a criminal act, and other children must be protected from bad actors. In addition to this, civil remedies are available. Parents may be entitled to recover financial compensation for the full extent of their child’s damages. The negligent daycare should be held liable for medical bills, required counseling/therapy, pain and suffering, emotional distress, and any long-term effects of the injury.
