Sudden Acceleration Cases
Experienced & Dedicated Personal Injury Lawyers
Sudden acceleration or sudden unintended acceleration occurs when a motor vehicle unexpectedly speeds up. It can happen as a result of a mechanical or electrical problem — and it could be associated with a total or partial loss of braking control. Sudden acceleration is one of the most frightening events that can happen to any driver. In a safe, properly manufactured vehicle, it should never occur.
At DC Law, our Austin product liability attorneys have the skills and experience needed to hold negligent automakers and other negligent manufacturers legally liable for injuries caused by dangerous and defective products. Over the last few decades, several prominent automakers have had serious issues with uncontrolled sudden acceleration in their vehicles. One of the first notable examples occurred in the middle of the 1980s. At that time, there was a major recall of Audi vehicles that were manufactured between 1982 and 1987. Federal regulators determined that these cars were at risk of unintended accelerations. At least 700 accidents and 6 deaths were linked to this product defect. More recently, Toyota recalled millions of vehicles due to problems with sudden accelerations. As reported by ABC News, Toyota eventually paid $1.2 billion in damages for concealing the issue.
Why sudden accelerations occur depends on a number of different factors. When these types of personal injury cases are raised, the big auto manufacturers almost invariably use the same defense: it was actually the driver’s fault. They will try to blame pedal misapplication on the part of the driver. While driver error is the cause of some unintended acceleration, it is certainly not the cause of all of them. Other causes of sudden accelerations include electrical problems, mechanical problems, and manufacturing flaws. This defect could manifest itself as an electronic throttle control problem, a stuck pedal, cruise control failure, or an unresponsive pedal.
