Handling Austin Motorcycle Accidents – Series Recap

This post is to conclude and recap our series on the handling of Austin, Texas motorcycle accidents. We decided to write on this topic because many victims do not know how to proceed after being injured and also may not know how to go about selecting a personal injury attorney. Our goal with this series has been to provide information which will help one to understand what it is they should expect from the process and to make a more informed decision when selecting counsel.

We have addressed several topics over our recent articles. Issues which we have looked at include:

These are important topics for multiple reasons. First, it is important that you not accept a “low ball” offer from insurance adjusters. If you accept a quick settlement then you may be left without the money needed to deal with future medical bills or to cover future lost wages. Second, many riders make the mistake of thinking that they will not be able to recover for an accident simply because they were partially at fault. As we have explained, Texas law will allow a victim to recover as long as they are not more than fifty percent responsible for the incident. Finally, discovery is a critical tool for establishing liability and dealing with issues related to comparative fault.

One point we have stressed throughout these posts is that you should contact an attorney immediately if you have been hit while riding a motorcycle. Counsel will immediately send a letter to the defendant’s insurance company which notifies the insurer that you are now represented. This will allow the insurer to deal with counsel directly so that you may focus on the important business of getting healthy. Once your damages can be reasonably determined, then your lawyer will send a demand for payment to the insurance adjuster. If a reasonable settlement cannot be reached then a lawsuit will likely be filed on your behalf. When selecting an attorney to help you with this process, it is necessary to choose one with the resources required to see your case through to completion.
